The following page contains essential information on the rights and responsibilities of all parties, including you, the customer; and a list of terms and conditions that all should agree to before commencement of business. Your interaction with Trampolines Australia constitutes your agreement to follow the terms and conditions and therefore be bound to them. If you do not agree to the following rules, then please refrain from purchasing products from the company. Trampolines Australia will take appropriate and considered actions to uphold these terms and conditions. Trampolines Australia reserves the right to change, add to, or delete the following terms and conditions at any time. While the company endeavours to provide up-to-date information via the website, please call customer service on 1300667514 to ensure that you have access to the most recent version. Trademark/Copyright All logos, images and text on Trampolines Australia’s products, catalogues and website are Copyrighted 2009 to Andon Corporation Pty Ltd. trading under Trampolines Australia. All trademarks are recognised. Without specific written permission from the appropriate parties, none of these trademarks or logos shall be used in any way. Delivery Delivery of the products is available to all residential and business addresses within Australia. Delivery and installation is available through Trampolines Australia within the Brisbane metropolitan area (please contact customer service to determine if your address falls within this zone). The customer will be contacted within three days to organise delivery day and time. Outside the Brisbane area, the delivery service is available through the general service (non-express) of an independent delivery company. Therefore, once leaving the Trampolines Australia depot in Brisbane, the delivery is covered under the terms and conditions of the independent provider, and not those of Trampolines Australia. Please refer to these here to ensure a timely delivery. Trampolines Australia will endeavour to provide timely delivery of the ordered products, however, the delivery times cannot be guaranteed. Express service cannot be supplied through this delivery provider. The approximate delivery times within Australia are as follows: Brisbane: 1-2 days Queensland: 2-4 days New South Wales: 2-4 days Victoria: 4-6 days South Australia: 4-7 days Tasmania: 7-8 days Western Australia: 4-6 days Northern Territory: 7-9 days All times are estimated only. Trampolines Australia bears no responsibility if these times are inaccurate for specific deliveries. These delivery times are from the date which the payment has entered the Andon Corporation LTD PTY T/ A Trampolines Australia account, until the trampoline arrives to the customers delivery address. Products must be paid for in full before delivered. Delivery and installation refunds are not available through Trampolines Australia, delivery refunds may be sought through the independent delivery provider. Website and Catalogue Information Trampolines Australia has attempted to provide the most accurate and updated information in the content of the website and its catalogues, providing accurate images and appropriate colours for our current stock range. However, the colours and models displayed may differ from the stock that you receive due to new stock lines and the colour settings of customers’ computers. Information provided on the website and catalogues is a guide only and should not be used to base decisions regarding the products. Please contact customer service to enquire about information on our current stock range. Prices on the website and in catalogues are subject to change at any time due to fluctuations within domestic and international markets, at the discretion of the appropriate parties. Consequently, while the website, catalogues and customer service staff will attempt to raise attention to future price changes, prices may change between inquiries and point of sale. Promotions are also subject to change at any time due to stock levels. While every attempt will be made to provide accurate information, promotions provided on the website or in catalogues do not constitute a binding agreement and information should be sought from customer service before purchase. Only promotions valid at point of purchase can be considered as binding. Warrantee All products advertised by Trampolines Australia come with manufacturing warrantees. Products are warranted to be free of defects in workmanship and materials. This warrantee applies to all parts of the purchased product for a 12 month period from the date of purchase due to normal usage. Proof of purchase is required when applying for a warrantee (i.e. a copy of the invoice). Delivery of the product is not covered under Trampolines Australia warrantee, and is dealt with under the terms and conditions of the independent delivery provider (see Delivery). If the product is faulty or does not include all parts, but is used anyway, any damage caused by the user will lead to a voiding of the stated warrantee. The product must be returned in the state that the customer received it in. It is essential that customers regularly check and follow the advice of the Safety and Maintenance section of the Trampolines Australia website to ensure longevity of their product. The warrantee does not extend to normal wear and tear of the product (i.e. spring stretch), UV deterioration and the warrantee is void if the product is used for any other activity than for what it was intended. Replacement parts or repairs required where evidence of such actions leading to product failure are not covered by the warrantee. The warrantee also does not cover personal injury or losses due to improper assembly or maintenance, nor damage due to neglect, misuse or accidents. Any claim for warrantee must be submitted via email with accompanying images of the damaged part and the date of purchase. If the warrantee claim is lodged within the first 7 days of the delivery date and is accepted, return delivery of the damaged part will be paid for by Trampolines Australia and the part replaced free of charge to the customer. After 7 days from the delivery date, the customer must pay for return delivery of the part claimed under warrantee to Trampolines Australia. Trampolines Australia will assist the customer in this action. If the warrantee claim is accepted, Trampolines Australia will provide the replacement part free of charge to the customer. Warrantee claims take up to 7 days to be processed by Trampolines Australia. Upon receipt of the damaged or faulty part, the replacement part will be despatched as soon as possible, and may take up to 7 days to reach the customer. Warrantee claims will lead to replacement of the faulty parts, not a refund. Refunds Within the first 7 days from the delivery date, a product not being claimed under warrantee may be returned for a full refund. While optional parts (i.e. springs, pads and nets) should fit Trampolines Australia’s products, we do not guarantee that these will fit other brands. Please check specifications with customer service staff before ordering. A refund form will need to be filled out (available from customer service) to provide a reason for the requested refund and a $25.00 restocking fee will be charged to the customer to cover costs associated with reintegration of the product into the Trampolines Australia system. Customers will need to organise and pay for return delivery of the product to Trampolines Australia and a refund is only acceptable if the product is returned in saleable condition.. Once the product has been received by Trampolines Australia, it may take up to 7 days for a refund to be processed and accepted. It may take a further 7 days for the refund to be processed by the relevant financial institutions. Any issues of over or under charging are to be dealt with by submitting a refund form to Trampolines Australia. It may take up to 7 days to approve the refund, and a further 7 days for the refund to be processed by the relevant financial institutions. Pre-ordering When ordering a product before it has arrived in stock, please note that the times provided for the arrival of stock at Trampolines Australia is only an estimate and is not guaranteed. Because of this, no refunds are available on pre-ordered products due to time delays. Refunds are at the discretion of Trampolines Australia. Communications In entering into dealings with Trampolines Australia, we agree that communications will be undertaken in a manner of maturity and respect regarding customers and staff members. All parties have the right to feel protected from harassment and abuse and Trampolines Australia will not tolerate such action against its employees. While we will deal with all reasonable claims and concerns promptly, Trampolines Australia reserves the right to cancel any transactions with full refund to any abusive party or pass the matter onto appropriate authorities. Incorrect Order Delivered If the customer receives an incorrect order (i.e. model, size, number of products), they are not entitled to a refund. However, Trampolines Australia will endeavour to correct the delivery mistake as soon as possible at no extra cost to the customer. Non-express return delivery and replacement will be arranged and provided by Trampolines Australia. Limitation of Liability and Disclaimer In no event will Trampolines Australia be accountable for any out of the ordinary, indirect or consequential damages including, but not limited to, the loss of data, business or profits. Trampolines Australia does not accept liability for consequential loss, injury or damage caused by events outside our control. This includes, but is not limited to, alteration, modification, misuse, neglect and repair. Trampolines Australia does not accept liability for injury or damaged cause by use of this product in a manner contrary to that intended by the manufacturer.
